Fort Myers man arrested on four DUI charges in April 2020 crash on Del Prado Boulevard

A Fort Myers man seriously hurt in an April 2020 crash in Cape Coral is now facing several DUI charges in the case.

Mathaniel  Allen Tuller, 37, was arrested Monday morning by Fort Myers police on a Cape Coral police warrant. He remains in Lee County Jail on $14,500 bond and is scheduled for arraignment Dec. 14.

Tulle was charged with DUI causing serious bodily injury, DUI with a blood-alcohol level of .15% or higher (legal limit in Florida is .08%), and two counts of DUI causing property damage.

Cape Coral police said the April 9 crash happened when Tuller, driving a 1995 Ford Thunderbird, was southbound in the 1700 block of Del Prado and in the left turn lane approaching the traffic light at the entrance of The Coral Pointe Mall.

Javier Flores, driving a 2015 Kia Soul, was northbound on Del Prado Boulevard South in the center travel lane approaching the same traffic light.

A third vehicle was westbound out of the mall and stopped for the red light in the inside left turn lane waiting to turn south onto Del Prado.

Both northbound and southbound Del Prado traffic had a green circle light giving Flores the right of way.

Tuller turned left at the same time Flores was driving through the intersection.

The Kia’s front bumper hit the front bumper of the Thunderbird and the front bumper of the third vehicle.   

Tuller and Xiemena Perez-Pernas, a passenger in the Kia, were trauma alerted to Lee Memorial Hospital in Fort Myers. Tuller was not wearing a seat belt.

Cape Coral police said two juveniles in the Kia, one seriously hurt and another with minor injuries, were not in child seats or wearing seatbelts.

Flores was cited for driving without a license and for not having children in car seats, police said.

The occupants of the third vehicle were not injured.
